Article 1. Definitions
- In these General Terms and Conditions, the following capitalized terms always have the following meaning:
General Terms and Conditions
these general terms and conditions of De Rijn Uitgeverij;
Login details
the combination of the Customer's username and password for placing an order on the Website;
Customer
the natural and/or legal person who places an order on the Website;
De Rijn Publishers
De Rijn Uitgeverij B.V., established and having its principal place of business in (2544GL) The Hague at Hengelolaan 974;
Agreement
the agreement between the Customer and De Rijn Uitgeverij concluded via the Website on the basis of which the Customer purchases the Product from De Rijn Uitgeverij;
Product
a product offered on the Website by De Rijn Uitgeverij;
Privacy Statement
the privacy statement of De Rijn Uitgeverij, which can be found on the Website;
Website
the website of De Rijn Uitgeverij, on which the Product is offered.
Article 2. Applicability
- The General Terms and Conditions apply to every offer from De Rijn Uitgeverij on the Website, the use of the Website and to every Agreement concluded via the Website.
- De Rijn Uitgeverij can always change and/or supplement these General Terms and Conditions. Changes do not apply to Agreements already concluded. The most current General Terms and Conditions can be found on the Website. If the Customer does not agree to the amended and/or supplemented General Terms and Conditions, the Customer can no longer order the Product.
- Any general terms and conditions or other terms and conditions of the Customer do not apply to the Agreement. De Rijn Uitgeverij expressly rejects this.
Article 3. Offer and conclusion of Agreement
- The Agreement is concluded by completing the ordering process, including acceptance of the General Terms and Conditions.
- An offer on the Website is always without obligation and can be revoked by De Rijn Uitgeverij immediately after an order has been placed.
- De Rijn Uitgeverij is not bound by apparent errors and mistakes in the offer on the Website.
Article 4. Use and availabilityof the Website
- De Rijn Uitgeverij does not guarantee that (price) information on the Website is always correct, current or complete.
- During the ordering process, the Customer can provide login details. When the Customer provides Login Details, he guarantees De Rijn Uitgeverij and is personally responsible for ensuring that i) the information he provides when creating his Login Details is correct, complete and current.
- The Customer is responsible and liable for all use made with his Login Details.
- As soon as the Customer knows or has reason to suspect that Login Details have come into the hands of unauthorized persons, the Customer must inform De Rijn Uitgeverij of this, without prejudice to his own obligation to immediately take effective measures, such as changing the Login Details.
- De Rijn Uitgeverij reserves the right to change the login procedure and/or the Customer's Login Details if it deems this necessary in the interest of the functioning of the Website.
Article 5. Price and payment
- The stated price of the Product is valid at the time it appears on the Website.
- VAT is included in the stated total price. Any additional costs, such as shipping and payment costs, will be stated on the Website.
- The Website states the payment options. If the Customer chooses a method of payment after delivery, the payment term depends on the chosen payment method, as indicated on the Website. The payment term is a deadline.
- If the Customer does not pay on time or De Rijn Uitgeverij is unable to collect the amount due before the end of the payment term using the payment method chosen by the Customer, the Customer is in default, regardless of whether De Rijn Uitgeverij sends a further reminder.
- If the Customer is in default with regard to its payment obligation, the Supplier can outsource the claim. In that case, costs incurred by De Rijn Uitgeverij will be borne by the Customer, in accordance with the scale for extrajudicial collection costs (BIK).
Article 6. Delivery
- Delivery times stated on the Website and/or in the ordering process are indicative and do not apply as a deadline.
Article 7. Privacy
- When visiting the Website, placing an order and providing login details, (personal) data is provided to De Rijn Uitgeverij. This (personal) data will be processed in accordance with: de privacy statement van De Rijn Uitgeverij and the applicable laws and regulations are processed.
Article 8. Reflection period and complaints
- The Customer has the right to terminate the Agreement within 14 days after receipt of the Product, without giving any reason, unless one of the exceptions in Article 6:230p of the Dutch Civil Code applies. If applicable, the Customer can exercise this right by submitting the model cancellation form as provided by De Rijn Uitgeverij and returning the delivered Product to De Rijn Uitgeverij. The costs of return shipment will be borne by the Customer.
- The cooling-off period referred to in paragraph 1 commences on the day after the customer, or a third party designated in advance by the customer, who is not the carrier, has received the product, or: a. if the customer has ordered multiple products in the same order: the day on which the customer, or a third party designated by him, has received the last product. The entrepreneur may, provided he has clearly informed the customer about this prior to the ordering process, refuse an order for multiple products with different delivery times.
- In the event of termination of the Agreement, the Customer is obliged to return the delivered Product that the Customer does not want as soon as possible, but no later than within 14 days. After the period of 14 days has expired, the customer is not entitled to return the products and De Rijn Uitgeverij is not obliged to accept the products.
- In the event of dissolution, De Rijn Uitgeverij will refund the amount already paid by the Customer under the Agreement within 14 days of receipt of the declaration of dissolution. De Rijn Uitgeverij is entitled to deduct the depreciation in value of the Product from the amounts to be repaid, insofar as that depreciation is the result of use by the Customer that goes beyond what is necessary to determine the nature, characteristics and operation of the Product.
- If the Customer has chosen a method of shipping other than the standard shipping method, only the costs for standard shipping will be refunded by De Rijn Uitgeverij.
- You can send complaints about the Product toinfo@uitgeverijderijn.nl. De Rijn Uitgeverij will respond substantively to the complaint within a reasonable period.
Article 9. Conformity
- If a Product does not comply with the Agreement, De Rijn Uitgeverij will repair the Product free of charge and within a reasonable period at the discretion of De Rijn Uitgeverij or, if a Product or parts thereof are missing, deliver it. If repair is not possible or cannot be required of De Rijn Uitgeverij, De Rijn Uitgeverij will replace the Product.
- If De Rijn Uitgeverij has not repaired the Product within a reasonable period, the Customer is entitled to turn to another party for repair. De Rijn Uitgeverij will reimburse the reasonable costs incurred by this third party with regard to the repair.
- A claim that the Product does not comply with the Agreement is not possible if the Customer was already aware or could reasonably have been aware of the defect when concluding the Agreement, or if the nature of the purchased Product or the nature of the defect precludes this.
Article 10. Liability
- De Rijn Uitgeverij is not liable for indirect damage or consequential damage, such as loss of profit, loss of turnover, loss of expected savings and other similar financial losses, as well as loss of goodwill or good name or reputation.
- To the extent that De Rijn Uitgeverij is liable, that liability is limited to a maximum of the price of the Product.
Article 11. Miscellaneous
- Customer may not transfer rights and obligations arising from the Agreement to third parties.
- Dutch law applies to the Agreement.
